These Terms of Service ("Terms") form a legally binding agreement between you ("you", "the user") and Dani Kabbani ("we", "us", "our"), operator of Pebble (pebble.eu.com, "the Service"). By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Service.
1. Description of the Service
Pebble is a prompt analysis tool that evaluates AI prompts against established prompt engineering frameworks and provides suggestions for improvement. The Service may include a free tier and, now or in the future, one or more paid tiers with additional features. We reserve the right to introduce, modify, or remove features and pricing at any time in accordance with Section 6.
2. Eligibility
You may use the Service only if you are at least 16 years of age. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms, and "you" refers to that organisation.
3. Acceptable use
You may use the Service for personal and commercial purposes, including improving prompts used for work, client projects, or your own products.
You agree not to:
- Submit prompts intended to generate harmful, illegal, defamatory, or abusive content;
- Use the Service to develop a competing product or to benchmark against it for competitive purposes without our written consent;
- Reverse-engineer, decompile, scrape, or attempt to extract the underlying source code, models, or prompt logic of the Service;
- Access the Service through automated means (bots, scripts, scrapers) beyond what is permitted by normal interactive use;
- Circumvent, disable, or interfere with usage limits, rate limiting, security features, or access controls;
- Resell, sublicense, or commercially exploit access to the Service without our written consent;
- Use the Service in any manner that violates applicable local, national, or international law.
We reserve the right to investigate and take appropriate action, including suspension or termination of access, against any user who violates this Section.
4. Usage limits
Access to the Service may be subject to usage limits, which vary by tier. We reserve the right to set, adjust, or remove these limits at our discretion. Excessive, abusive, or automated usage may result in temporary or permanent suspension of access without notice.
5. Accounts
Certain features may require you to create an account. You are responsible for:
- Providing accurate information when registering;
- Maintaining the confidentiality of your login credentials;
- All activity that occurs under your account.
You must notify us promptly of any unauthorised use of your account. You may request account deletion at any time via your account settings. This starts a 60-day grace period during which you can cancel the deletion request. If you do not cancel, your account and all associated data will be automatically and permanently deleted after 60 days, as described in our Privacy Policy. We reserve the right to suspend or terminate accounts that violate these Terms.
6. Pricing, paid features, and changes
The Service may offer paid features or subscription tiers. Where paid features are offered:
- Prices and the scope of paid features will be displayed before purchase;
- You agree to pay all applicable fees and taxes associated with your selected tier;
- We may change pricing, introduce new paid features, or modify the features available in any tier. Where such changes affect an active paid subscription, we will provide reasonable advance notice;
- Unless required by law, fees already paid are non-refundable except where explicitly stated.
We reserve the right to change whether any particular feature is free or paid at any time. Continued use of the Service after a pricing change constitutes acceptance of the new terms.
7. Your content and intellectual property
You retain all ownership rights in the prompts and content you submit ("User Content"). By submitting User Content, you grant us a limited, non-exclusive, royalty-free licence to process, transmit, and store that content solely for the purpose of operating and providing the Service to you.
We do not use your User Content to train artificial intelligence models. We do not claim ownership of your prompts.
All rights in the Service itself — including its design, code, branding, framework logic, and the "Pebble" name — remain our exclusive property. Nothing in these Terms grants you any right to our intellectual property beyond the limited right to use the Service as intended.
8. Third-party processing
The Service relies on third-party providers, including Anthropic (for AI processing), Vercel (for hosting), and Supabase (for data storage). By using the Service, you acknowledge that your prompts and data are processed by these providers as described in our Privacy Policy. We are not responsible for the independent acts or omissions of these third parties.
9. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- The feedback provided is accurate, complete, reliable, or suitable for your specific purpose;
- The Service will be uninterrupted, secure, or error-free;
- Any defects will be corrected.
Prompt engineering is not an exact science. You are solely responsible for evaluating and relying on any output from the Service. Nothing in these Terms excludes liability that cannot be excluded under applicable mandatory law.
10. Limitation of liability
To the fullest extent permitted by applicable law:
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service;
- Our total aggregate liability arising out of or relating to the Service shall not exceed the greater of (a) the total amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred euros (€100).
Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be limited or excluded under German law.
11. Indemnification
You agree to indemnify and hold harmless Dani Kabbani from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right.
12. Suspension and termination
We may suspend or terminate your access to the Service at any time, with or without notice, if you breach these Terms or if we reasonably believe your use poses a risk to the Service, other users, or us. You may stop using the Service at any time. Provisions that by their nature should survive termination (including Sections 7, 9, 10, 11, and 14) shall survive.
13. Changes to the Service and these Terms
We may modify, suspend, or discontinue all or part of the Service at any time. We may also revise these Terms from time to time. Material changes will be communicated via the Service, and the "Last updated" date will be revised. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
14. Governing law and jurisdiction
These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding its conflict-of-law provisions and the UN Convention on Contracts for the International Sale of Goods (CISG). To the extent permitted by law, the courts of Berlin, Germany shall have exclusive jurisdiction over any disputes arising from these Terms or the Service. Mandatory consumer protection rights in your country of residence remain unaffected.
15. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or removed to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
